Effective date: September 2, 2026

These Terms and Conditions (“Terms”) govern your use of the BHIVE Performance System website and your purchase of, enrollment in, or participation in any BHIVE program, course, coaching service, training, event, membership, digital product, or related service. By using this website or making a purchase, you agree to these Terms.

Programs and Services

BHIVE provides professional-development programs, sales training, coaching, educational materials, and related services. Program descriptions, schedules, instructors, delivery methods, included materials, and availability may change when reasonably necessary. Any significant changes will be communicated to affected participants.

Programs may be delivered through recorded content, downloadable materials, live virtual sessions, onsite instruction, individual coaching, group coaching, or a combination of these methods.

Eligibility and Account Responsibility

You must be at least 18 years old and legally able to enter into an agreement to purchase or participate in a BHIVE program. You are responsible for providing accurate registration, billing, and contact information and for maintaining the confidentiality of your account credentials.

Pricing and Payment

Prices, payment schedules, and included services are displayed on the applicable program page or checkout page. You agree to pay the total price and any applicable taxes or separately approved expenses shown before purchase.

Checkout, order, installment-payment, subscription, and customer-account functions may be provided through SureCart and its connected payment processors. By submitting an order, you authorize the charges disclosed at checkout according to the payment option you select.

Refunds and Cancellations

A customer may request a refund only before program access has been provided or the program has begun, whichever occurs first. Once access has been provided, materials have been delivered, or the program has begun, payments are nonrefundable and any remaining installments remain due.

Refund requests must be submitted through the BHIVE Contact page and include the purchaser’s name, email address, program name, and order information.

BHIVE may, at its sole discretion, approve a refund, cancellation, credit, transfer, or payment adjustment as an exception. Granting an exception in one instance does not require BHIVE to grant similar exceptions in the future.

Schedule Changes and Cancellations by BHIVE

BHIVE may reasonably reschedule a session, substitute a comparable delivery method, or modify a program schedule when necessary. If BHIVE cancels a paid program and does not provide a reasonable replacement or rescheduled option, affected customers will receive an appropriate refund or credit for the portion BHIVE did not provide.

Onsite and Customized Training

Onsite builder training, customized programs, consulting, and approved travel expenses may be governed by a separate proposal, invoice, or written agreement. If a specific written agreement conflicts with these general Terms, the specific written agreement controls for that engagement.

Educational Purpose and Results

BHIVE programs provide education, training, coaching, and professional-development support. Results depend on many factors, including participation, effort, experience, market conditions, employer decisions, and implementation. BHIVE does not guarantee employment, interviews, promotions, sales, commissions, income, business growth, licensing, or any other particular result.

BHIVE content is not legal, tax, accounting, financial, medical, or mental-health advice. You are responsible for obtaining qualified professional advice when appropriate and for complying with laws, regulations, licensing requirements, employer policies, and professional standards applicable to you.

Intellectual Property

BHIVE’s website content, videos, recordings, workbooks, guides, worksheets, exercises, graphics, program materials, methods, and other original content are owned by or licensed to BHIVE and are protected by applicable intellectual-property laws.

Your purchase provides a limited, personal, nonexclusive, nontransferable license to use the materials for your own education and professional development. Unless BHIVE gives written permission, you may not copy, reproduce, sell, share, publish, upload, distribute, sublicense, teach from, or create derivative commercial products from BHIVE materials. Login credentials and program access may not be shared.

Participant Conduct

Participants must behave professionally and respectfully. You may not harass others, disrupt sessions, misuse confidential information, infringe intellectual property, attempt unauthorized access, distribute harmful technology, or use BHIVE services for unlawful purposes. BHIVE may remove or suspend a participant for serious or repeated misconduct. Removal for misconduct does not eliminate payment obligations or create a right to a refund.

Recordings and Participant Information

Some virtual or live sessions may be recorded for participant review, internal quality control, or program delivery. BHIVE will provide reasonable notice when a session is being recorded. Participants must not independently record or distribute sessions without written permission.

Personal information is handled according to the BHIVE Privacy Policy. Participants should avoid sharing confidential employer, customer, financial, health, or other sensitive information during group sessions.

Third-Party Services and Links

The website and programs may use or link to third-party services, including payment, video-conferencing, email, hosting, and customer-account providers. Those services are governed by their own terms and privacy policies. BHIVE is not responsible for third-party websites, services, outages, or practices outside BHIVE’s reasonable control.

Website Availability

BHIVE works to keep its website and digital services available but does not guarantee uninterrupted or error-free access. Maintenance, technical problems, security concerns, third-party outages, or events outside BHIVE’s reasonable control may temporarily affect availability.

Disclaimer of Warranties

To the fullest extent permitted by law, the website, programs, materials, and services are provided “as is” and “as available.” BHIVE disclaims warranties not expressly stated in these Terms, including implied warranties of merchantability, fitness for a particular purpose, and noninfringement.

Limitation of Liability

To the fullest extent permitted by law, BHIVE will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; lost income, profits, opportunities, data, or goodwill; or decisions made based on program content.

To the fullest extent permitted by law, BHIVE’s total liability arising from a particular program, purchase, or service will not exceed the amount you paid BHIVE for that program, purchase, or service during the twelve months preceding the event giving rise to the claim. Nothing in these Terms excludes liability that cannot legally be limited or excluded.

Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Any dispute that cannot be resolved informally will be handled by a court of competent jurisdiction in Florida, subject to any rights that applicable consumer law does not allow you to waive.

Changes to These Terms

BHIVE may update these Terms to reflect changes in services, business practices, technology, or legal requirements. The effective date at the top of this page will be updated when material changes are made. The Terms in effect when you make a purchase will generally govern that purchase unless a change is required by law or you agree otherwise.

General Provisions

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect. A failure to enforce any provision is not a waiver of the right to enforce it later. These Terms, together with the Privacy Policy, the applicable offer and checkout disclosures, and any specific written agreement, constitute the agreement between you and BHIVE regarding the applicable website use, program, or service.
